Fire Safety Regulations & Responsibilities
Compliance with UK fire safety legislation is a legal requirement for all business premises.
The primary legislation governing fire safety in non-domestic premises in England and Wales is the Regulatory Reform (Fire Safety) Order 2005 (as amended by the Fire Safety Act 2021 and the Building Safety Act 2022). Scotland is governed by the Fire (Scotland) Act 2005 and the Fire Safety (Scotland) Regulations 2006. Northern Ireland is governed by the Fire and Rescue Services (Northern Ireland) Order 2006 and the Fire Safety Regulations (Northern Ireland) 2010
Key Requirements:
- Fire Risk Assessment:Â Must be carried out by a competent person and regularly reviewed
- Adequate Fire Detection:Â Appropriate fire alarm system based on risk assessment
- Emergency Routes & Exits:Â Clearly marked, unobstructed and sufficient for building occupancy
- Fire Safety Equipment:Â Properly installed, maintained and tested
- Staff Training:Â Employees must receive adequate fire safety training
Failure to comply can result in unlimited fines and imprisonment for responsible persons.
The "Responsible Person" (employer, owner, landlord, or occupier) has specific legal duties under fire safety legislation:
- Carry out and maintain a suitable and sufficient fire risk assessment
- Implement appropriate fire safety measures based on the risk assessment
- Inform and instruct employees about fire risks and safety procedures
- Provide adequate training to employees on fire safety measures
- Coordinate measures with other responsible persons in shared premises
- Establish procedures for serious and imminent danger
- Appoint competent persons to assist with fire safety duties
- Ensure equipment is maintained in good working order
The Responsible Person can delegate tasks but cannot delegate responsibility for compliance.
